USPTO Revises Guidance on Subject Matter Eligibility (35 USC 101) and Application of 35 USC 112 to Computer-Implemented Inventions
The USPTO issued a release stating: The United States Patent and Trademark Office (USPTO) today announced revised guidance for subject matter eligibility under 35 U.S.C. § 101. The USPTO also announced guidance on the application of 35 U.S.C. § 112 to computer-implemented inventions. The documents take effect Monday, January 7, 2019.

In response to the continued interest of stakeholders around the world, the USPTO has extended the Patents 4 Patients Cancer Immunotherapy Pilot Program through June 30, 2020. All pilot parameters remain the same as first implemented on June 29, 2016.

Oblon was co-counsel for ZitoVault, LLC at the Federal Circuit in the appeal for the AMAZON.COM, INC., AMAZON.COM, LLC, AMAZON WEB SERVICES, INC., BAZAARVOICE, INC., GEARBOX SOFTWARE, LLC, v. ZITOVAULT, LLC Inter Partes Review (IPR). On Nov. 16, 2018, the Federal Circuit affirmed the decision of the PTAB finding that Petitioners had not shown that any of ZitoVault's claims were unpatentable.
